JUDY FLUHARTY FINALLY WINS, BUT NOT CHILDREN
AFTER losing two appeals for her two children, Judith Fluharty was awarded $17,000 in damages July 3rd because her former husband, Larry, tapped her phone for more than a year during their child custody fight.
In May of 1978, Larry Fluharty was granted custody of their two boys. What prompted Larry to receive the custody of the boys was Judy's testimony deny. ing a telephone conversation in which she admitted a homosexual interest. When told of the existence of the tapes, Ms Fluharty admitted having the conversation. Following that testimony, Summit County Common Pleas Judge, Richard Zurz granted Mr. Fluharty custody.
In February, Judy sued her ex-husband in U. S. District Court, where she challenged the wiretap as a violation of federal law and an invasion of privacy. U. S. District Judge, Leroy J. Contie Jr., upheld her claim.
On July 3rd, the jury awarded Judy $17,000 in damages and $3,500 in lawyers fees. Two of Judy's friends, Susan Schlagel and Carol Miller were awarded $1,000 compensatory damages and $300.00 lawyers fees. $1,000 was awarded to Judy's lawyer, John Wolfe for damages.
Also,
Jerry Montgomery, Mr. Fluharty's lawyer, said he will appeal the damage award. He said interspousal immunity would prohibit awarding such civil damages, although he said he agrees that the wiretap was a criminal violation.

ON JUNE 30th, another hearing on the continuing case of Canton Psychologist, Timothy Hilaeel, operator of Canton Psych Lab Inc. was held.

Estelle Johnson of Canton, whose son was supposedly corrupted claimed she had seen Hilacel in a bar wearing a dress, high healed shoes, and silk stockings. | deny this also, said Hilaeel. Hilaeel even denied telling Mrs Johnson's son that sex was all right and that he never advocated or suggested he engage in sexual activities.
Bridget Frohme of Canton also testified that Hilaeel had made sexual advances to her and suggested they have an affair. Hilaeel also denied these charges. Defense attorney, Niki Schwartz in cross examination pulled out an apron which in-laws of Mrs Frohme gave to Hilaeel for a birthday present.
